Technical Details:

You will receive a confirmation email upon completing registration and paying registration fees.

The videos for recorded sessions will be available to view as individual videos on the Association of Attorney-Mediators Course Library Page or "Program Hub". Your registration confirmation email will include a link and details on how to access the videos. You will need to create an account in the course library/program hub to gain access to the videos.

Handouts/materials will be included as a download link in the email as well as posted in the course library next to the videos.

Instructions on how to access and view the video will also be included in this email.

Please note that each video contains an on-screen pop up verification code that must be reported for attendance purposes. Please keep an eye out and write down the code while viewing the video.

After viewing the videos, you will need to complete an online record of attendance form, called a "CLE Verification" form in the course library. This will generate a certificate of attendance for your files, for AAM Office recordkeeping and form CLE/CME reporting purposes. More details will be included in the registration confirmation email.

“Insulting” First Offers:

How to Respond to Them, How to Deliver Them.

This workshop examines a problem that bedevils even experienced mediators: Parties’ insistence on making extreme opening offers that frustrate bargaining and may lead to impasse. We will explore why bargainers make insulting offers and how to respond to and convey them to opposing parties. We’ll also review video in which leading mediators deal with this phenomenon and discuss what we see in small groups.

About our speaker:

Dwight Golann is Research Professor at UC Law-San Francisco and Suffolk University Law School. He is the author of leading books on commercial mediation, Mediating Legal Disputes, and mediation advocacy, Sharing a Mediator’s Powers, as well as law school texts and numerous articles.

Professor Golann has led trainings for federal and state courts, the Federal Judicial Center, the Justice Department, the European Union, and ADR organizations on five continents. As a mediator he has resolved hundreds of legal disputes in a wide variety of subject areas.

Professor Golann is the recipient of the Lifetime Achievement Award of the American College of Civil Mediators, an Honorary Member of the International Academy of Mediators and recipient of the American Bar Association’s Award for Outstanding Scholarship in Dispute Resolution. He is a graduate of Amherst College and Harvard Law School.

Course Description:

When embattled parties come to mediation, they are often awash in emotions and impulses that make for difficult interactions. The Internal Family Systems (IFS) model provides a non-pathologizing language and framework for helping each party manage their own internal negotiation and manage the fearful, enraged, or wounded parts of themselves that are driving the conflict. IFS also offers mediators, lawyers, and other professionals clear, practical ways to work with their own emotions. This interactive program will include case examples, an experiential exercise, and opportunities for small group discussion.

2027 Annual Meeting and CLE Seminar (April 01, 2027)
