Current Responsibilities: Mr. Peña is an Arbitrator and Mediator. His office is in Arlington, He currently serves as an Arbitrator on the American Arbitration Association’s Employment Panel, FMCS’s Labor Arbitration Panel and the National Mediation Board. He also serves as a Public Arbitrator for FINRA, an Arbitrator and Mediator for the Texas Department of Insurance and an Independent Hearing Examiner for the Texas Education Agency. He is a certified Mediator in the State of Texas.

Professional Experience: Mr. Peña has been a member of the State Bar of Texas since 1983. Mr. Peña worked in private practice for six years before joining the Southwestern Bell Telephone Company Legal Department. He remained at Southwestern Bell (subsequently AT&T Communications) for twenty-nine years focusing on labor & employment matters, having tried mor than 85 labor arbitrations. Throughout his legal career, he has tried cases in state and federal courts and at the appellate level. He has litigated: labor & employment cases, wrongful death cases, personal injury cases, discrimination cases, oil & gas cases and business disputes. In 2005, Scene in San Antonio, recognized Mr. Peña as one of “San Antonio’s Best Lawyers” for labor & employment.

Professional Leadership: Governor George W. Bush appointed Mr. Peña twice to serve on the Texas Judicial Council (1995 and 1997). He currently serves as a volunteer mediator for the Dispute Resolution Services of North Texas.

Education: Mr. Peña has a B.A. from the University of Notre Dame and a J.D. from the University of Texas at Austin School of Law. He also has an M. A. in History from the University of Texas at San Antonio.

Mediation Philosophy: Disputes belongs to the parties. As a mediator, I do not force settlements; I listen to the parties and review the relevant records. I work to facilitate negotiations to find common ground. If asked, I provide my neutral objective assessment regarding strengths and weaknesses. My assessment is based on my experiences litigating cases in court. I do not guide my parties to settle the easy way—e.g., splitting the baby. I work to find concrete and realistic resolutions in emotional and challenging disputes.
